Workers' Comp Hearing Preparation, Without the Scramble

Hearing prep is usually reconstruction. The facts were established months ago and nobody wrote them down in a form the next person could use.

The week before a hearing has a recognisable shape. Someone pulls the file, re-reads the medical, rebuilds the timeline, re-checks which examiner said what, and writes it all down again. Most of it was known already. It just was not written down anywhere reusable.

Hearing-ready means a specific thing

  • A timeline of treatment and events, each entry citing its source page.
  • Physician opinions separated by examiner, with dates and conclusions.
  • The contradictions surfaced and either adopted or discarded on purpose.
  • Exhibits identified and reachable, not theoretically locatable.
  • The disputed issues stated plainly, with what supports each side.

Build it once, not the week before

If the chronology is assembled when records arrive rather than when the hearing is set, prep stops being reconstruction and becomes review. The attorney reads what is there, corrects what is wrong, and spends the remaining time on argument.

The part that cannot be prepared for you

Theory of the case, which facts to lead with, what to concede, how a particular judge responds. None of that is assembly work, and none of it should be automated. The purpose of preparing the record properly is to leave time for exactly this.

Preparation should be reading the file, not rebuilding it.
